threats of violence

can a person go to jail if they threated to kill some one even if the person who was threatened is not pressing charges

First and most important a person does not press charges. Only the District Attorney can file charges against a person. Once the police become involved they make the first level decision as to whether the case should be referred to the DA. Then the DA decides whether or not to press charges. The victim has no control over the situation.
