Legal Question in Family Law in California

Title of home

I am the sole owner of my home. Only my name is on title. It is property of my trust. My husband signed a quitclaim on the property. Does he have any claim to it in the event of a divorce? Can I sign it over to any of my kids to prevent any claim he may have?

Re: Title of home

As a general rule your husband would not have any interest in the trust which is owned by your trust. However, if community funds were used to improve the house, or pay the mortgage there may be a community property interest in the house. Transferring the house to your child or children will not defeat any community property interest in the house.
