Legal Question in Family Law in California

Mother moves daughter to Virginia. Father stays in San Diego. Mother summons Father to Virginia court to register San Diego visitation with Virginia court. Can Father ignore summons? Can mother register without Father's permission? If so, can visitation be modified thru Virginia court later? Mother using UCCJEA vehicle to accomplish. At same time filed for child support increase in San Diego court. Court dates are 2 days apart.

Registration of the court order is for enforcement only. The order cannot be modified in Virginia without consent of the California court. The California court maintains jurisdiction to modify the child support order and the child custody order. Based upon what you have said, there would be no need to appear in Virginia. You must, of course, reply to the San Diego court modification request. Good Luck, Pat McCrary
