Legal Question in Family Law in California

Can a wife go after a husband for spousal support if the husband is elderly, on complete disability, and not employed. Wife is not employed and is getting social security. Husband is getting social security and disability.

Either spouse can go after the other for support, but who will get it is another matter. First the marriage must be "of long duration." There is a presumption that ten years is long and less is not, though some spousal support may be ordered for shorter marriages. IF support is warranted, there is a long list of things that are to be considered in deciding who should get what support. You'd need to go over your exact circumstances and finances with an attorney to get any kind of evaluation of possible outcomes.
