Legal Question in Family Law in California

Wife not making payments on mobile home in my name

I did a divorce through ''we are the people'' and listed a mobilehome and the loan # as part of her assets. However, the loan is in my name only and she is not making timely payments and I am getting hit with property tax liens from the county recorder. She has poor credit and WILL NOT get the loan in her name. The lender doesnt recognize the transfer of property. There must be something I can do to force the sale of the home or something based on her bad debt practices? This is killing my credit...

This one of the many reasons that people should not be using document prpearation services for their divorces. You save some money up front and it costs you dearly in the long term.

Unfortunately, your remedies are limied by the terms and language of the judgment. Depending on how much time has passed since the judgment, perhaps you can seek to have it set aside.

In any event, you should write to the lender and all credit reporting agencies advising them of the situation and requesting the agencies to place the information regarding the divorce judgmentin your file.

You should, even at this late stage, retain counsel to help you.

In a general sense, your remedies are limited by the language of the underlying judgment. Based upon my experience with the work product of We The People, I would not expect much but you should have the document reviewed by an experienced family law lawyer.

Good luck to you.
