Legal Question in Family Law in California

Can my wife's attorney advise her not to let me see my 9mo son if there is no history of wrong doing in any way, restraining order, or custody papers/court orders yet? Can she and her attorney dictate how long, when, and where I see my son? Will this uncooperation be in my favor when it comes to meadation?

Your wife's attorney can advise her in any way that they see fit. Having said that, whether your wife's attorney is giving her good and proper advice is another thing. I don't know what she has alleged to her attorney, so I can't make that call. If the court and/or mediation sees that they are being uncooperative without good cause, and in an effort to undermine what would be in the best interest of the minor child, it could ultimately work in your favor.
