my elderly mother

my father is in the hospital dying, my mother is 88 yrs old and is in need of my help. I'am I eligable for family leave?

Probably, if the company and you both qualify. Apply for it. If denied, then consult with local counsel.

Focus on needing to be available to help your father, not your mother. Family leave is intended to be for employees to care for a seriously ill family member such as a parent. The employer may request that your father's health care provider certify that that your assistance is necessary for his care. If you cannot provide such certification for your mother, you may have a problem.
