Legal Question in Medical Leave in California

FMLA intermittent leave

I suffer from post herpetic neuralgia. I wake up fine in the morning and my pain increases as the day progresses. I have a reasonable accomodation to work through my lunch and leave early as needed. I am also on FMLA, and request 15 minutes a day intermittent FMLA leave. I catch a bus and two trains each day, and i need to leave early enough to accomodate all the schedules. I am being denied those 15 minutes. Are my rights being violated?

Re: FMLA intermittent leave

If your doctor reports support the need for such special accommodation, then you may have a claim. Such factors determine your needs and rights. If the company is already accommodating by lunch and departure times, you need to discuss the remaining accomodation with them to determine how to resolve the issue. They don't have to do everything you want, only what is legally required. If you want to get legal help in this, feel free to contacat me.
