fmla paperwork

is there any paperwork to fill out for an incapacitated person or does his employer fill any paperwork out to receive fmla?

All you have to do is request the FMLA leave from the employer, and provide doctor's verification if requested by the employer. There is no formal paperwork. If improperly denied the leave by the employer, feel free to contact me for help.

While no formal paperwork is necessary to initiate a request for FMLA, as long as some form of communication is clear that the employee is seriously ill and cannot work, the employer may request that the illness be certified by a healthcare provider. Most employers have specific forms for this purpose but they can also be obtained from the California Department of Fair Employment and Housing or the Equal Employment Opportunity Commission. It is always a good idea to reduce all communication to writing to avoid any misunderstanding.
