Legal Question in Medical Leave in California

maternity leave

My wife went on maternity leave and the company (Cigna) approved and paid her leave. Now that she's gone back to work they're saying its denied and they are going to garnish her wages, to pay back all the money. They asked her to sign a paper. Should she sign it? And will state retro pay the money if Cigna takes it back

Re: maternity leave

Without knowing all the facts and allegations, there is no way to give an intelligent answer. If they approved the leave and now deny it, they would need a valid reason, such as 'fraud'. You stated none. You need to consult with counsel to review the facts and documents before making any decisions. Check with your local Bar Association or Lawyers Referral Service.

Re: maternity leave

Should she sign the paper? I have no idea without knowing what it says. You need an attorney to review ALL the facts, otherwise it is like a doctor operating without knowing everything about the patient.
