Legal Question in Federal Tort Claims in California

FTCA, secret microphoning, entrapment

As a firefighter with a large So. Cal. Federal FD, I was subjected to numerous heinous acts of reprisal, hostile work environment, discrimination and disparate treatment.

I want to sue two individuals for the intentional infliction of emotional distress caused when they secretly micro phoned me while baiting me into a trap over the course of an evening in Dec. 2003. It was premeditated, by my captain and a female co-worker he was involved with.

The 3 chiefs above us helped plan and implement this scheme and I will bring suit against them as well.

I did not fall for the entrapment. I have their admissions and photos of these, and many other damaging actions.

I am timely for the FTCA requirements, filed a proper Administrative claim, and received a final denial by the agency after exhaustive appeals.

I am hoping the state courts would honor the federal requirements to fulfill the administrative processes, and allow a personal tort suit against these employees for their actions.

I have filed a discrimination case in district court, and it is refreshing to have a court address both the agency and myself in an authoritative tone as opposed to the condescending answers I have received for the last four years from just
