Legal Question in Civil Litigation in California
Please let me know if these actions have any legal ramification.
My husband was having a secret relationship with another woman. I did not know her, but was able to locate her online. I created a fake account with her picture, in an attempt to contact her husband and let him know about the situation. The account had no threats on it or any names.
She says she is pressing charges against me because I am crazy, have created chaos in her life, I harrassed her and threatened her.
I did call her and one time, but I dont recall what the conversation was about. I was intoxicated (Not an excuse) and all I remember is yelling.
What are the chances of that holding up in court? As far as the threat its her word against mine?

Pressing charges mean going to the police to see if they will do anything. They probably would not do more than to speak with you. She could civilly sue you and it is normally the situation in that type of case that it merely is one person's work against another and the jury has to determine whom to believe. Since it costs a fair amount of money to sue, she probably will not find any attorney willing to do so since her alleged damages seem too small.
The other woman may be able to get a restraining order against you. Even if she tries to get one but fails, defending yourself will take time, money and energy.
You might also be prosecuted for identity theft or various computer crimes, depending upon how and where you set up the "fake account" you mention and what you did with it.
