Legal Question in Civil Litigation in California

i need advice

i bought a used toyota camary about 3 yrs ago. It came with a car max report saying everything was good on it. Well I got on a car accident on May 25, 2007 and the air bags did not deploy so caused me to break my noise. I do have car insurance but only liability so it does not cover my car. So I am wondering is there something I can do?

I am sorry to hear about what happened. I hope you are doing better now. There may be a lot of options, including pursing claims against the dealer, Toyota, etc. More information would be required to give an adequate analysis, however.

A carmax report only describes the vehicle's history. It does not guarantee that all of the car's equipment works, let alone that it will still work three years later. Unless there is more to the story, I don't see how you can hold them liable for your injury.

You might have a cause of action against the seller, the manufacturer or some other party, but I see no claim against carmax based upon the limited facts you have provided.

Your statement that your auto insurance "does not cover my car" suggests that you hope to sue somebody for the damage your car sustained. I doubt that the airbag's failure to deploy caused any damage. In fact, many airbags actually cause significant damage when they deploy; the failure of your airbag to do so thus may have saved you money overall. I would need to know more about the accident before I could say whether anyone else might be liable for the damage to your car.
