civil harrassement

I dated this guy a few times but we have known each other for quite some time. It kind of leaded nowhere and I dated someone else but he didn't want to accept it. I never really told him or wrote him that I didn't want to see him again. He sent me several emails saying that we are great together, that we should try etc... He annoys me. Is that enough to get a civil harrassement restraining order? What are the exact law to file for a civil harrassement RO in california? How long it takes once the form are filled to get the judge look at the TRO and proceed with the hearing? Do I have to make it clear by writing first that I don't want to see him anymore? thanks
