Legal Question in Civil Litigation in California

Collect a debt

About a year ago I loaned my boyfriend at the time $10,000. He has paid me back $3900. He still owes me $6100. We both signed a paper stating that this was a loan and he is to pay me back the full amount. Well, he has not paid anything since May. He started his own business and he keeps telling me that he will pay me but he doesnt. I need to take him to court to get the rest of my money. Can I attach his wages (he still has a full time job) and put a lien on his business? And how do I start the process?

Re: Collect a debt

You can bring a small claims lawsuit. Once you get a judgment in your favor, you file a few more papers with the court and bring them to the sheriff to levy his wages and/or bank account(s). Good luck.

Go to small claims court and follow their directions.
