Legal Question in Civil Litigation in California

my dog bit a person. our neighbor had taken down a wall in the back yard which caused the dogs to get out of our yard and into their yard. he clains to have grabbed the dog and he turned and bit him. we were never told they would be changing anythind with the back yard fence or we would have put the dogs away. would we still be held liable due to the CA law?
