Legal Question in Civil Litigation in California

I dropped my IMac at the apple store for repair on August 10th they said it will be repaired by September 1st, they didn't repair it till October 4th when I got the first email to pick it up, I couldn't pick it up since I was out of town and they were late, I got another email from them on November 19th an exact replica of the one on October 4th notifying me that my product is ready for pick up, I went today jan 5th to pick it up and they told me they have basically threw it away.

It's was a 2200 computer, with priceless data on it, I am a musician and I have all my 3 years creation and work on this computer.

I never received any warning from them regarding disposing of my computer, what my legal rights here?

I am sorry to hear of your situation, and hope you had a backup of your work.

If the computer cannot be returned, your only legal remedy is in the courts for monetary damages. If your claim is less than $10,000 your remedy is in small claims court.

You should also follow up with the store to see if they have a complaints process that you can follow.
