Ex Empoyer

My ex employer is being sued by my former boss for wrongful termination. At the time of his employment I was his assistant. A few weeks weeks ago I was supenoed by my former boss attorney (plantiff). I went to court and gave my testimony and my witness fees were reimbursed by the plantiff. Again this week I was supenoed but this time for the defendant (my former employer) and want to know if I am suppose to recieve witness fees from the defendant for my appearance?

Yes, you can collect from anyone who subpoenaes you. The defense probably decided not to ask you all the questions it could on cross-examination but rather call you as their own witness. They can not ask you leading questions [plaintiff now can when they question you] but can go into areas that the plaintiff did not ask you about on direct examination.

To rdue the amount of time you waste waiting to testify, ask the defendance attorney if he can tell you approximately when you will testify and if you can make it to the court house in 20 minutes could you stay at work and come as soon as he calls you? He has the right to say no. You can speak with the plaintiffs attorney if you want. You will find that the easiest way t keep your testimony consistent is to just tell the truth as you know it.
