Legal Question in Civil Litigation in California

False Police Reports and Identity Theft

My husband had and affair that ended badly. We recently found out that she has filed police reports claiming that he has threatened her, has beat her up and has tried to run her over. She has also gotten a restraining order against him, though he has not done anything to her. What can we do?

Also, we found out that she had used his D.L. number and S.S. number to get two cell phones in his name. We have contacted the police and the cell phone company, but is there anything else we can do?

Re: False Police Reports and Identity Theft

This is a very bad situation which will require detailed legal help. There may be many options, but the most important is to realize that she is wrong in seeking out her revenge. You should retain counsel and go over all the details. You may be able to get the restaining order lifted and have the phones taken out of your husbands name. If you are in the Greater Los Angeles area call me to discuss this further.
