Family Plan Dispute

I am being sued for the deactiviation of a phone, and monthly payment for a phone I haven't used in two months and I left the family plan without any remaining balance, and made it know that I was no longer using the phone at the end of the billing cycle I indicated would be my last. When we got the plan we agreed that everything would be split down the middle like a plan should be. When I stopped using the phone, I told the person that I would pay my last bill but couldn't pay for the deactivation fee at the current time. (Unknowingly she kept the voicemail message) I was not on the phone contract nor did I see a single bill. And not until recently the phone company has brought it to my attention that I had been paying a majority of the bill. The person keeps calling my home phone demanding that I pay, and only until recently did they say that they'd been recording every message that they left on my phone. The person has also been calling my job as well. Please advise me in the situation. Also can I countersue the person for the detailing I had to do on my car from her throwing up in my car when she was drunk, I have a police report stating that she was constantly throwing up as my car was in motion. Will that stand in court?
