Is a filing fee always required when filing a small claims action?

Unless you can prove to the court that the filing fee should be waived because of your income and/or expenses, a filing fee is required.

If you meet certain financial criteria, you can get a waiver of the filing fee. See the court clerk for the necessary forms. Otherwise, you must pay a filing fee based on the amount of your claim.
