Can I take a foreign exchange student to small claims court?

I purchased a vehicle from a foreign exchange student. I

bought the vehicle ''as is''. On the next day I was going to get

it smogged but it didn't pass. We agreed on taking it to a

mechanic to take care of the problem ( he paid for it). Since

the check engine light wouldn't come off he gave me a

fraudulent smog report. I accepted it but two days later the

car broke down. Can I sew him for selling me a lemon or

giving me a fraudulent smog certificate? He will be going back

to his home country soon. is there any way I can take him to

court?how would that work?

Anyone in the US can be sued.

Your problem looks like it will be enforcing the judgment.
