fraud from ebay seller

how do i get my money back or recieve my item i won a bid on a harley engine for 3200 usd. the seller said he shipped it but will not prove it with a shippers ticket. there was shipping ins. on it. i reported it to ebay and the seller also will not respone to me . i reported it to the san jose police fraud dept. on line and with many calls on the sargents voise mail with no responce i live in canada and do not know what to do

If the police and eBay don't help you, you could sue the seller. If you were local, you could sue in small claims court and handle it yourself. You could file and serve all the papers in Small Claims court by mail, and come to town for the day of trial. You could hire an attorney to sue in Superior Court, but the attorney fees would reduce your recovery. You could 'assign your claim' to someone local who could sue in small claims court and 'share' the recovery with you.
