Legal Question in Civil Litigation in California

My (now ex) girlfriend financed a new motocycle for me in 2007. Now she has taken the motocycle from me and will not return the estimated $5,000 that I have invested. She found a contract on line when we first got the motocycle that we bouth signed that stated she was selling me the motocycle as long as I made all the payments on time witch I have done. Can I recover my $5,000?

Well, I do not know what is in that contract but if it calls for you making the payments on time and you continue to have possession of the bike, then she cannot just repossess it. Unless there's something in the contract that allows her to do so. If you have proof that you have not breached the contract, then it's apparent that she has breached it, you can file a small-claims lawsuit against her for damages. You might be able to get your $5,000 downpayment back.
