Legal Question in Civil Litigation in California

Hi,

My maintanence required light was on in my car so I took it to my local garage to determine what the problem was. The mechanic reset the light but never told me what the problem was but did tell me I needed an oil change. I had the oil change and two weeks later my transmission went out because I didn't have any transmission fluid. I took my car to a third party mechanic to check the transmission for any leaks and per the third party mechanic there was no leaks, Is the mechanic whom did the oil change liable for the damages to my transmission?

If he was supposed to check what was causing the light to be on and low transmission fluid would cause the light to go on [especially if needing an oil change would have no effect on the light] e would be liable. You would have to go to small claims court with a statement under penalty of perjury from a mechanic that that was the situation.

Not based on what you have told us. Mr. Shers has a point in that you need to know whether or not the transmission fluid would cause the check engine light to go on when it was low. It has never affected the check engine light in any of the cars I have ever owned, but I don't know what kind of car you have.
