Legal Question in Civil Litigation in California

is it illegal for someone to say over the phone that "this is kim, i am sallys legal counsel" when they are not a lawyer?

This should have been posted to Legal Ethics, but that is OK. It is illegal for someone to hold themselves out as being an attorney, when they are not licensed to practice law. This is rarely prosecuted, however, and is only a misdemeanor in the State of California.
