Jealous Boss is Trying Precipitate Termination

I had my performance review last week with my supervisor and our boss in attendance. During the discussion, I mentioned certain problems I resolve on my shift to illustrate my value to the company. I feel my supervisor took umbrage to these comments because unbeknownst to me she had never discussed these issues with our boss-who was surprised by these issues. The next day, when I was looking for a file at her desk drawer, I found several of my personal e-mails that had been printed from my computer-none of which could remotely considered inappropriate or in bad taste, one of which was a tasteful reply to a query from a co-worker asking my impression of her grown daughter. Our ex supervisor thinks she's trying to get me fired-while I'm a top performer with no negatives at work, I wonder if any legal action or notice is required on my part, to protect my interests or compensate me for what is now a hostile environment.

California is an at-will state. You may be terminated for any reason, or no reason at all, so long as it's not an illegal reason. Illegal reasons include discrimination on the basis of sex, race, marital or family status, sexual orientation, disability, medical condition, age, etc. Also, you cannot be terminated in retaliation for blowing the whistle on illegal activities. You might qualify for a workers comp stress claim (perhaps re-post the query for a workers comp attorney). I would make sure to back up all e-mails and take them off site. Do not keep any personal papers at the office, since you may not have an expectation of privacy in your computer or closed desk drawer.

You might also bring the situation to a superior's attention if it becomes untenable. I wish you well.

Mr. Cohen is correct in his reply. Unfortunately, if you don't have a written employment agreement and if the reasons are not prohibited by law, you can be fired for no reason at any time. If you think you are being set up, start looking for a better job.
