Legal Question in Civil Litigation in California

Rental car payment after collision

I was involved in a car collision, the other drivers insurance has accepted full liability, The other drivers insurance company has given me a prelimenary check to start repairs with a notice of paying supplementary damage if the check does not cover all repair expenses, my car is in the process of getting repaired by a body shop of my choosing, and the other drivers insurance is paying for a rental car.

The other drivers insurance will only pay for the rental car from the day the body shop started repairs till the day the repairs are completed. But I have accrued $1000.00 dollars in rental car expenses from the day my car was hit till the day there insurance company gave the ok to the body shop to start repairs.

Question: Can I and if so how do I get compensated for the rental car expense?

Re: Rental car payment after collision

Just sue the person in Small Claims Court for your out of pocket costs. It'll be fast and easy. If insurance adjuster shows up, object and do not let him/her to talk. In Small Claims only parties and witnesses are allowed.

Take the pictures of your car as well as the repair bills, estimates, rental bills, letters from insurance adjusters, especially those that accept liability.

Good luck.

Ask for it. However, if they do not pay, then you can sue for it in small claims or make it part of the damages if you sue for personal injuries.
