Legal Question in Civil Litigation in California

I rented a house to a tenant the tenet caused property damage to a trash can. Now my home owners association is suing me and not the tenant. Can they do that?

Yes. As between you and the HOA you are responsible for your tenant's conduct. You have the right to cross-complain against the tenant for indemnity.

I agree with Mr. McCormick, although I'm puzzled that a HOA would hire a lawyer and sue over a damaged trash can. I feel that there is more to your story than you let on.

You might want to review your lease to see if there is a right to issue a three-day notice to your tenants and try to induce them to either repair the damage or move.
