Legal Question in Civil Litigation in California

Restraining Order

I was issued a temporary restraining order and court papers. In the paperwork, it states that I must appear in Court if I want to dispute the order. Do I still need to go to court if I don't want to dispute the order? Also, it states that I own guns and must relinquish them, but I sold my guns over 4 years ago, and have none now. What do I do about this?

Re: Restraining Order

If you don't mind being prohibited from EVER possessing, using or owning a gun again for life, you don't have to do anything. If that restraining order remains unopposed, that will be the case. Contact local counsel familiar with gun rights to protect yourself from that outcome.

Re: Restraining Order

Sounds like you'll still want to appear to clarify the gun issue and make sure the actual order isn't more onerous than it needs to be. The order will show up when people search lawsuits filed against you, so the better the order, the better off you'll be.
