Legal Question in Civil Litigation in California

I had a run-in with someone on the street the other day. They got angry when i didn\'t see them crossing the road at night and stopped suddenly when i did see them. They then approached my car and kicked a dent in it. I got out and called the police and took down their information. Will they be liable for such property damage? Is it considered a property tort? Would the court potentially throw out my case because I was the one that made the driving error in the first place? (not that it would excuse the property damage, but just want to consider all facts) Thanks.

The person would be liable for damages to your car since your vehicle never touched the person. You might let your insurance carrier know if it's worth it.
