Legal Question in Civil Litigation in California

Thank you for this service. I recently moved my business from one location to a new site. I moved due to a variety of reasons but the main one being that the lease was up and I chose not to renew. I shared space with another business at the old location. When moving day came, I ended up having to go to the emergency room and was admitted to the hospital. My husband and staff were trying to finish the move, but ended up having to leave some items behind, explaining my situation and saying we would return for the items. The owner of the other bus is refusing to give them back to me. I have tried contacting her both by phone and e-mail to no avail. I have gone in, and she has not been there when she said she would be. I would like to avoid small claims court, and am looking for a bit less confrontational way to solve my problem

Thank you

Carol Harris

Hi Carol,

I would be happy to write a polite but firm letter. People tend to consider letters from attorneys a bit more. I dont see why the other owner would continue to unlawfully keep your property after being formally requested to return it. Are you both on the lease? Do you have any written agreement with the owner of the other business?

Best,
