Small Claims Regulations

In a small claims proceeding, can you sue for more than the five thousand dollar limit if it's for pain and suffering. If the answer is yes, how much can you sue for.

California's $5,000 limit is for the total amount. You can still sue in Municipal or Superior court, a small claims court just doesn't have jurisdiction to order anything over $5,000.
