DMV may have lost it, but it's on you for not keeping a copy. Get the police report and have your attorney file a cross-complaint against the owner and the driver.

Hope you kept copies of all documents that prove the sale, and hope you have witnesses to corroborate all. You'll need them to convince the plaintiff's attorney to drop you, or to use in your defense in the litigation if he refuses. Call you insurance company to try to get them to defend you. If you end up needing to hire your own attorney, feel free to contact me.

You can use the bill of sale. I hope you kept it.
