Legal Question in Civil Litigation in California

Will not give me my car

I bought a car from transmasters transmissions. I have a reciept and i have the car in my name. I have the pink slip on its way. They wrote me a bill of sale. The manager told me that it needed a transmission. that is why it was a lean sale car and been on the lot for almost a year. now after 3 months of waiting for the car. he tells me that yes it it ready but he wants 500.00 more for the vehicle. That i already own. I went to court and filed small claims. The same day he was served the department of child services was called and the next day pulled my kids out of class. I confronted him and he admitted to calling in a false report. and said its just the beginning. besides a restraining order. is there anything else i can do for him to stop harrassing me or can i file for more money for harrassment????

Report the guy to the District Attorney for filing a false report with a county agency. You also might have a lawsuit for intentional infliction of emotional distress, and might be able to seek punitive damages. I'm not sure if an auto dealer must be licensed but, if so, his conduct should warrant a licensing board investigation. Good luck!

Re: Will not give me my car

if he truly HAS admitted this to you, (and i hope you have witnesses / tape recording / etc.), this guy is in a lot of potential trouble. call the district attorney . . . do not pass go.

i assume that there will also be a record that it is him who made the call to child services.

call. NOW.

good luck
