Legal Question in Civil Litigation in California

X Boyfriend in possession of vehicle in my name.

I took out a loan on a vehicle for my boyfriend who promised to pay me back for it. When we broke up he said he had the money and would pay off the remainder directly to the bank, at which point I would have them forward the title directly to him. He has not paid and will not contact me. What can I do? There is $7,000 remaining on the balance and payments get deducted from my account each month.

This is called anticipatory breach of contract. Rather than suing when each payment becomes due, you can file a small claims lawsuit for the full amount. If your name is on title, you might repossess the vehicle. If it's not, I hope you have some proof (e-mails, notes, etc.) that show that you and he entered into the agreement. Good luck.
