Legal Question in Immigration Law in California

Adjustment of status in ciudad Juarez

Hello! i have been married with a US citizen for about 6 years, since we didnt file a family petition before the end of april 2002, i do know that i am not elegible to adjust status while in the US, now my question is, how long would it take for me to adjust or get a visa if i leave the country, i know that ciudad Juarez has a consulate where all this process can be done, right?, now i did a little research and i know that i would have to get a waiver for me to be able to come back in to the country, how long do they take? i have a clean record, also we have a 4 year old daughter, leaving would be kind of difficult but if its the only option to adjust, please let me know if i have a good chance!! thank you!

If you entered the US without a visa, then you may have to go back to Mexico for the visa application and waiver. It can take from 6 months to more than 1 year for you to wait outside of US. The likelihood of success depends on each individual case.

Please seek formal legal advice before take any actions.
