Legal Question in Immigration Law in California

dear Lawguru,

I am currently holding an L1 visa and married to a US LPR and I plan to give birth to my child overseas. My question is, since I (the mother) am not an LPR, how can my husband (LPR) and I bring our child back to the United States? Does our child automatically get an LPR status through the father who is an LPR?

No it will not. You will have to apply and go through the application / qualification process. However, if your child were to be born in the US your child will be a US citizen automatically. Perhaps you should reconsider your plan giving birth oversees.
