divorce-green card

What happens If I file for divorce 2 weeks after I obtain conditional green card from immigration by reason of alcoholism, verbal and mental abuse ? Can I stay in the US legally and get my 10 year green card eventually (of course I have proofs that my husband is being abusive toward me)?

Thank you for your inquiry. It is possible to file for a waiver of the joint application requirement to remove the conditions on your green card. It is very important to document the reasons why you are divorcing. You may wish to obtain affidavits and should obtain medical records (if any) that will bolster your allegations. It is also imporant that your divorce is final before you apply to remove the conditions on your residence. You may wish to hire counsel to assist you. Yes...it is possible. You need to document the abuse you are facing. Always remember...you need to show that you had entered the marriage in good faith...and the reason why the marriage did not work out.
