Legal Question in Immigration Law in California

Expired Student Visa from Africa

My friend came to America on a 6 month student visa - they said they would renew it for 5 years but he would have to pay for school then and he din't have the money - so now he has been here for several years on an expired visa - is there anything he can do to become legal?

Thanks.

Re: Expired Student Visa from Africa

Thank you for your inquiry.

With an expired visa, your friend is considered out of status, period, and is deportable or must otherwise leave the country.

However, re-entry is possible with employment, a separate school sponsor, under a family petition where one member of his or her immediate family is a citizen, through marriage to a US Citizen, or investment, some of which may or may not be applicable.

I hope that this answers your question, but if you need more information, have other questions you need answered, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can.
