Legal Question in Immigration Law in California

Can a greencard be revoked?

My dad is a US citizen who married someone from another country. They got married here in the US. They have been married for a over 2 years now. Her true colors have started to come out. She's not even really inlove with my dad. She just used him so that she and her daughter can come here in the US and get their greencards. She's very selfish and doesn't help pay for any bills. She just keeps all the money to herself and her family and sends it back to her country. Is there anything anyone can do to revoke her greencard and send her back to her country?

Re: Can a greencard be revoked?

This is in inquiry that should be made by your father. It is his choice. If he has been married to this woman for two years, he is required to file an application to remove the condition of temporary resident -- he can choose not to file such a document for the reasons you specify. On the other hand, if the USCIS has already granted her PERMANENT residency, there isn't much he can do unless he can prove fraud -- that is difficult at this stage of the game because the government would wonder why he didn't find this out sooner; maybe he is simply having a "marriage" problem. He should be discussing this with his wife, not his child. Good luck!

Your matter is complex and you should get an attorney. If you are located in Orange, San Diego or Imperial Counties, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.
