Legal Question in Immigration Law in California

I am an H1 b visa holder and have maintained my status through out. My wife entered the US legally around 1999--2000, but over stayed since then. My employer just started my GC process and when i filled out my questionnaire, I answered as being married. However, i did not provide any information on my wife's status. The attorney handling this case asked me for my wife's status and her status expiration date? I am in a dilemma to respond to her question. Can i file my GC and reveal true information and status about her or -- should i ask my attorney to pursue the GC process without disclosing any information about my spouse, since I do not wish to add her on my GC process anyways. PLease help !!

Your wife, unfortunately, will not be able to obtain a green card with you through your employer.

For a detailed advice you shall consult a good immigration attorney in private (phone, email, in-person). The attorney who handles the case is an attorney for your employer, first of all, and might have to disclose all information to them. Some information about a spouse has to be disclosed to the USCIS.
