Legal Question in Immigration Law in California

Hello

I am an Indian(different country)married to a US citizen.My husband was a fraud ,he tourtured me a lot after our marriage and ran away to US after 11 months of marriage.We also have a baby from this marriage.Its been 2 � years that he is not in touch with me and neither giving any of my rights and baby�s rights. I want to fight for my baby�s right now or in other words wants to file for child support services in USA .I asked child support services in US for this and they said I will have to come to US to file for this.

My question is �I want to apply for US visitor visa now and will the embassy give me the visitor visa if I tell them the truth that I am going there to US to file for child support services so that my baby gets his rights as life is very uncertain and if I die tomorrow than who will take care of my baby?Do you think they will give me and my baby VISA on these grounds.My baby also deserves US citizenship by right(being a child of US citizen).Please suggest.I have also registered the complaint with the embassy earlier that my husband is a fraud and ran to US.Please suggest what is the way out .
