Legal Question in Immigration Law in California

Hello!

I'm on F-1 visa status right now, I've came into this country 3 years ago as a J-1 student.

I've been in the marriage for 7 months right now, the problem is my husband keeps hitting me, threatens me, tries to keep me locked in the house. I want to file for viwa, but i'm afraid I'll get a denial- I've already been married to a us citizen before , we didn't file for any documents though, because we divorced after 3 months. are previous marriages considered a real problem in these cases?

I'm sorry to hear about your situation. The previous marriage might or might not be a problem. You need to provide more information and discuss it with a knowledgeable immigration attorney (information on different internet forums is rarely reliable). As to your current situation, yes, you should be able to self-petition under VAWA as an abused spouse of a US citizen. Whether it will be approved or denied - is too early to say.
