Legal Question in Immigration Law in California

Hi

I came to US under the J1 Visa in Aug 2011. Last May I summitted the application for changing my status from J1 to F1. I get the receipt from them , they told me they accepted my application on 27June, 2012. The process for changing will take from 2-3 months, but until i have not get any decision from them. I did call them, but they told me like I should keep waiting. My visa expired already.

The question is I am in Us now legal or not.

Should I ask laywer for help?
