It depends on if you mean your dad applied for you directly from the time he was a resident and what country you are from. It's important to bear in mind that in this case, you must remain unmarried. It might be possible that you could qualify to apply to adjust status in another way sooner. That application allows filing the permit to work, but not before. I'd need to know more to see if there is a faster way.

The above information is general and not legal advice. An attorney client relationship is formed based on mutual agreement and not via this internet information.

Dear Inquirer:

Depending on your country of birth and marital status, we may be able to file an application for your "adjustment of status" presently. If you are eligible, you will be issued a work authorization in approximately 90 days and the green card could be obtained in approximately 6-8 months.

I recommend that email us at [email protected] or call 626 585 8005 if you would like to schedule an appointment for a confidential consultation to discuss this matter further.

It is possible that depending on your country of birth and present marital status, that an application for adjustment of status could be filed. Otherwise, if you must still wait, it's possible that there are other methods to pursue obtaining your greencard, since your Dad's petition was filed for you in May, 1995, and you would be 245i eligible. I would be happy to assist you in your immigration matters, and can be contacted at 415-387-1364 or email: [email protected].
