L-1B transfer to L-1A

Sir/Madam,

I have been advised that it may be an option to transfer to L1A status to help with my green card application. However as I understand you must be able to show that you were employed in a managerial level capacity abroad for at least one year. Please let me know if this is the case and how one should provide such evidence. E.g. is this just a letter of referall? and what is exactly meant by being employed in a managerial capacity? E.g. could your title be consultant yet you could have had 3 individuals reporting to you on a team - would that be applicable?

Thank you for your email. It is possible to switch from an L-1B to an L-1A. The USCIS bases its decisions regarding these matters on a number of different factors including job title, job description, industry norms, etc. In order to properly advise you I would need to review your L-1B petition and the details regarding both your job abroad and your proposed position in the US as well as information on both companies. Without reviewing your underline petition it is very hard to advise...what would be proper evidence. Business cards showing your title, correpondence...will do.

It is more than just your title. It is based on your job duties. You would need to have a lawyer review these before you decide that this is your only option.
