Legal Question in Immigration Law in California

Need help!!!

My partner came to the US illegally from Mexico 13 years ago with her parents when she was 9 years old. She has grown up here and only knows the US as her home. She graduated high school and has taken some college courses. She speaks/reads and writes English. She is a person of good moral character and has never been in trouble with the law. We are very afraid that one day she could be deported. All she wants is to be given an opportunity to succeed and live her life here in the US legally. Is there anything that she or I can do to get her legal status here in the US? Please help!!

Hi,

There might be a few things that can be done for her if she is in fact a person of good moral character.

First, it will be important to find out if there is any paperoiwk filed for her since she has arrived to the US 13 years ago. Even if she never completed the process, a mere filing of certain papers might qualify her for some relief now based on her marriage to you for example.

If nothing has been filed, there is a way to fight her case through the US Embassy in Mexico after a relative petition has been approved in the US. The way to go about it is through a waiver application based on extreme hardship to you her US citizen spouse.

Finally if the law changes in the mean time, she will not need to leave and have her case processed outside the United States.
