Legal Question in Immigration Law in California

I would like to petition for a fiance visa for my boyfriend who is in mexico. My only concern is that he came to the U.S without inspection back in 05 because I was diagnosed with breast cancer. He was fingerprinted for a job at an assisted living facility but only stayed in the U.S. for about two weeks. He had to return to mexico because his daughter became very ill. Would I have any problems with the fiance visa petition.
