Legal Question in Immigration Law in California

I'm out of status for almost 2 years now..I'm not also a beneficiary filed before April 2001..My question is- Can I apply or somebody apply for me for an I-864? I badly need to adjust my status..Anyone concern..I highly appreciate your help. Thank you so much..

Is your priority date current? When the I-130 was filed (date) and in what category (who filed for you)? If a priority date is not current yet, no one can file I-864. It also makes no sense to do.

First, a priority date should become current.

Second, YOUR petitioner files the I-864 Affidavit of support, and you apply for adjustment of status, if eligible.

Then, if a petitioner's income is not sufficient, you can use a co-sponsor (another person) as a joint sponsor in order to meet the Affidavit of support requirements.

The I-864 relates to a case with an immigrant petition, so you need that for the I-864 to be a solution. The only scenario would be bonafide marriage to a U.S. citizen spouse or if you had a US citizen child who is at least 21 years old.
